Illegal Weapons in Texas

One of the most common types of weapons crimes is possession of an illegal weapon. Texas outlaws certain weapons. Having one of these weapons in your possession can lead to criminal charges and harsh penalties.

In Texas, it is illegal to possess any of the following weapons:

  • Short-barrel shotguns
  • Machine guns
  • Zip guns
  • Silencers
  • Armor-piercing bullets/ammunition
  • Explosives
  • Finger rings, guards, and other “knuckle” weapons
  • Devices that dispense dangerous chemicals
  • Tire-deflating devices

While there are various exceptions, the possession of any of the above weapons is typically charged as a third-degree felony. A conviction can lead to steep fines and incarceration.

Understanding Texas Gun Laws

Although Texas has some of the least strict gun laws in the nation, there are still several important laws regarding your Second Amendment rights that you need to know. Most gun offenses in our state involve the unlawful carrying of a firearm/weapon.

First and foremost, certain individuals are not allowed to possess a firearm. These individuals include:

  • Convicted felons of less than five years; after five years, convicted felons may only possess firearms on their own property
  • Individuals who have been convicted of misdemeanor domestic violence assault of a family member, spouse, or household member within the past five years
  • Individuals subject to and who have received notice of a protective order (restraining order) under the Family Code

Secondly, individuals who have the right to possess a firearm may only do so in certain areas and under certain conditions. You may only possess a firearm, illegal knife, or club on your own property, property you manage or control, or in/directly en route to your car, boat, or other personal vehicle. Additionally, you may not possess a handgun if you are engaged in criminal or gang activity or if the handgun is in plain view, even if you are in your own vehicle or on your own property.
