Types of Assault in Texas

  • Felony Assault (First, Second, or Third Degree): Felony assault includes threats of bodily harm or offensive physical contact involving a spouse or domestic partner, family member, security officer, public servant, government official, police officer, witness, and/or emergency personnel. Assault may also be charged as a felony if the alleged act included choking or the restriction of oxygen/blood supply of the alleged victim or when the alleged offender has prior assault convictions.
  • Aggravated Assault: Any assault may be charged as an aggravated assault when the alleged act results in serious bodily injury. The use of a weapon during the alleged act will also likely result in charges of aggravated assault.

A misdemeanor assault charge may result in fines of up to $500 whereas a first-degree felony assault conviction can result in a prison term of five years to life, plus fines reaching $10,000.
